Terms & Conditions for Advertisers

1. Introduction

These Terms and Conditions (“Agreement”) are made between you (the “Advertiser”) and ROTOR Network (“ROTOR Network,” “we,” “us,” “our”). By accessing or using our advertising services, you agree to these Terms & Conditions. If you do not agree to these terms, you must not use our services.

2. Services

ROTOR Network offers businesses a platform to place on-hold audio advertisements on call centers and other business phone systems. Advertisers may submit audio advertisements to be played by hosts within the ROTOR Network.

3. Ad Placement

  • Ad Content: Advertisers provide us with audio advertisements (mostly in MP3 format, but sometimes in wav, depending on your system) to be played on hosts’ phone systems. Advertisements must comply with ROTOR Network’s content guidelines and may not contain:
    • False or misleading claims.
    • Offensive, discriminatory, or harmful content.
    • Content that violates any applicable laws or regulations.
    • Content promoting products or services that are illegal or prohibited (e.g., drugs, gambling).
  • Ad Placement Process: Once your advertisement has been submitted and approved, it will be placed in the relevant rotation for eligible hosts (call centers, businesses) to play during on-hold or queue times.

4. Payment Terms

  • Pricing: Advertisers will pay at a rate of 1 cent per second (or equivalent in pound sterling or Euro) for the duration of each advertisement. Payment is based on the volume of your ad campaign.
  • Billing & Payments: All invoices are issued upon submission of your advertisement and must be paid in full within 30 days of the invoice date unless otherwise agreed. Payments can be made via Stripe, PayPal, or bank transfer.

5. Ad Content Approval

  • All ads submitted to ROTOR Network must be reviewed and approved. We reserve the right to reject any ad that does not comply with our content standards.
  • Once an ad is approved, it will be scheduled for placement within available host queues. Approval and placement typically takes place within 24 hours after payment.

6. Campaign Duration & Termination

  • Campaign Length: Your advertising campaign will run until your total ad plays have been met / exceeded.
  • Termination: You may terminate your campaign at any time by providing notice to ROTOR Network.
  • Suspension of Ads: ROTOR Network reserves the right to suspend or remove any ad at any time if it violates our content guidelines or for any other reason we deem necessary. You will be notified if this occurs.

Clause on Ad Interruptions (Duds):
Rotor guarantees the full playback of all contracted advertisements. However, advertisements interrupted due to a caller resuming the call or any unforeseen circumstances are considered ‘duds.’

  • Advertisements 60 seconds or shorter: Duds will not be charged, and these ads will be re-queued for playback until completed in full.
  • Advertisements longer than 60 seconds: Rotor will charge in full for such ads, regardless of whether they were played fully or partially. Advertisers are encouraged to submit concise ads to maximize completion rates and effectiveness.

7. Reporting

  • Ad Play Reporting: ROTOR Network will provide a report via email to the advertiser once their campaign has ended. The report will contain details of the number of ad plays, duration, and the relevant hosts that played your ads.
  • Analytics: While we track ad play activity, ROTOR Network does not guarantee specific performance metrics, such as the number of callers that will hear your ad.

8. Intellectual Property

  • Ownership: You retain full ownership of the intellectual property in your ads, including audio files and trademarks. By submitting your ad, you grant ROTOR Network a non-exclusive, worldwide license to play your ad on our platform.
  • Usage Rights: Your ads will only be used for the purposes of this advertising campaign and as agreed between you and ROTOR Network.

9. Liability

  • ROTOR Network is not responsible for any technical issues, interruptions, or errors in the playback of your ads caused by external factors such as host system failures or internet outages.
  • You acknowledge and accept that ROTOR Network is not liable for any direct or indirect loss, damage, or claims arising from the use of our service, including but not limited to any lost opportunities or revenue.

10. Refunds & Disputes

  • Refunds: ROTOR Network does not offer refunds for ads already played. If there are any issues with ad performance or ad playback, please contact our support team for assistance.(Please see our FAQ page for more information on our refund policy).
  • Disputes: Any disputes regarding billing, service interruptions, or campaign performance should be reported to ROTOR Network within 30 days of the event. We will make every effort to resolve the issue promptly.

11. Confidentiality

  • Both parties agree to keep any confidential information shared during the course of this agreement confidential and not to disclose it to third parties without prior written consent.

12. Amendments

  • ROTOR Network reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated to you, and your continued use of our services will be considered acceptance of the modified terms.
